When you’re going through a divorce, it can be a confusing time in your life. Between coming to terms with the changes in your life to accepting your emotional response to all of the challenges being thrown your way, divorces are taxing in more ways than one. When you add to all of your personal struggles the need to determine an equitable division of property in a divorce, it can seem absolutely impossible to come to a fair agreement. That’s why at AMS Mediation, our Burnsville, MN divorce mediators want to help you experience as simple a divorce as possible by providing mediation services to help you determine the best property division settlement for your divorce. By simply looking over your past expenses with your spouse, including all marital property, we can help you come to a quick agreement regarding division of property.

What is Marital Property?

A large part of understanding property division in divorce is understanding what is considered marital property. Essentially, marital property is all assets and liabilities acquired during your marriage. In other words, all income and financial assets, as well as any debts you or your spouse has acquired during your marriage. All property obtained prior to a marriage is not considered marital property, and therefore it is not considered when making property division agreements. The only property you need to worry about during your divorce, then, is the marital property that has been legally shared between you and your partner.

Dividing Assets and Liabilities Fairly

Each marriage functions differently, and while some partners may be financially dependent upon each other with several investments, assets, and debts to each of their names, other marriages are not so complex. Overall, when we take on property division challenges, we use spreadsheets to keep all financial responsibilities and assets accounted for throughout the divorce process so that everyone is aware of every asset and liability each party has acquired. Based on the financial information you and your spouse provide, we are able to come up with an equitable property division figure that reflects the numbers you’ve given us.

Low-Conflict Property Division Resolutions

In order to perform low-conflict divorce meditations for property division, we make sure that the numbers speak for themselves. That means that your property division agreement will be based solely on the financial information you provide and nothing else. That way, both you and your spouse can be comfortable knowing that you are reaching the fairest property division agreement possible – whether it feels like it or not. At AMS Mediation, you’ll be able to avoid the conflict of a courtroom divorce, settling property division resolutions quickly. We are experienced Burnsville, Minnesota divorce mediators, helping partners separate with as little conflict as possible and with as fair an agreement as we can make based on the figures we receive.
