A Beginners Guide to Divorce MediationOne thing most of us have in common when we go through a divorce is that we are beginners. You have experience with a divorce because you have not been through it before. However, this can create some additional stress about the process. Divorce mediation has become a highly effective and popular mechanism for settling the terms of a divorce, with many people choosing it over litigation. If you are beginning the divorce process for the first time, here are some basic principles that will help you navigate it successfully:

● Divorce mediation is less expensive and less time consuming than litigation.
● Mediation can be less stressful than a court battle for you and your children.
● Your mediator will not make decisions in your case, can answer process questions and will facilitate productive discussions that can result in your divorce settlement.
● The Minnesota court system requires that you attempt an alternative dispute resolution technique like mediation before going through the court system.
● You can settle all of the terms of your divorce via mediation including dividing your assets, deciding on a parenting plan (also known as a custody agreement) and determining whether child support or spousal maintenance is needed.
● You are not required to have a lawyer to represent you in the mediation process.
● You can expect to need 3-4 two-hour mediation sessions over the course of 6-12 weeks to complete the process. Your mediator can then make sure that your divorce agreement is filed in court.
● You can complete virtual or in person mediation sessions depending on your preference and your schedule.
● Mediation is entirely confidential and can work even in high conflict divorces.
● Mediation allows you to have a lot of input in the outcome and is very often more successful as a result in the long term.
● The mediation process is often less emotionally taxing on your children than a long and contentious court battle.

While providing virtual ADR services was not part of our plan, we have made the necessary accommodations to ensure we can continue to serve our clients during these unsettling times. All services are currently available through virtually. We are using Zoom for videoconferencing. Limited In-Person Services

We have resumed limited in-person services for sessions with 1 or 2 participants scheduled for a maximum of 2 hours. Masks are required in our building and in session. Availability is subject to change based on local regulations and CDC guidelines.
