In most cases, both parties want to spend as much time as possible with their children and the idea of splitting this time is painful to think about. In addition, you and your soon to be ex may have very different opinions about what is best for your kids as it relates to a custody arrangement. If you and your ex have worked to try to reach a custody agreement and have not yet been successful, the Minnesota courts may require that you engage with a custody evaluator to complete a court ordered custody evaluation to move the process forward in a positive and healthy way. Amber Serwat of AMS Mediation is a MN Custody Evaluator and can work with you to resolve even the most difficult custody cases.

What Is Involved in a Court Ordered Custody Evaluation?

The ultimate goal of a court ordered custody evaluation is to arrive at a custody arrangement that is in the best interest of the children. A custody evaluation can take up to three to six months to complete and the court will very often rely on these recommendations. The court will review the evaluation and make the final determination about the custody arrangement. Working with Amber Serwat for a court ordered custody evaluation includes the following components:

  1. Investigation: Amber Serwat will interview all members of your family including children (if they are old enough) and both parents. This phase may also include home visits, communication with health care providers, teachers, personal references, and a review of relevant reports and documents relevant to the custody arrangement.
  2. Written Report: After the investigation, Amber can write a report to submit to the court if you and your ex cannot agree on a custody arrangement after her recommendations are presented.
  3. Testimony (if needed): If your custody case goes to trial, Amber can testify as an expert on behalf of one or both parties.
