Three Components of a Custody SettlementA comprehensive custody settlement typically addresses three key areas: legal custody, physical custody, and child support. Each component plays a vital role in ensuring the well-being of your child and fostering a cooperative co-parenting relationship.

Mediation offers a confidential and less adversarial environment for resolving custody matters. Unlike court proceedings, mediation empowers parents to make decisions collaboratively, fostering mutual respect and reducing conflict. This approach not only benefits the parents but also promotes a healthier emotional environment for the child.

1. Legal Custody: Decision-Making Authority
Legal custody pertains to the right to make significant decisions about your child’s upbringing, including education, healthcare, and religious instruction. In Minnesota, parents may share joint legal custody, promoting collaborative decision-making, or one parent may be granted sole legal custody if joint decision-making is not feasible. Our mediators assist parents in evaluating their communication dynamics and the best interests of the child to determine the most suitable legal custody arrangement.
2. Physical Custody: Daily Care and Residence
Physical custody determines where the child resides and who is responsible for daily care. Minnesota courts recognize both sole and joint physical custody, with arrangements tailored to the child’s needs and the parents’ circumstances. Through mediation, parents can develop a parenting time schedule that reflects their unique family dynamics, ensuring consistency and stability for the child.
3. Child Support: Financial Responsibility

Child support involves the financial contributions required to meet the child’s needs, including housing, food, education, and healthcare. Minnesota utilizes guidelines to calculate support obligations, considering factors such as each parent’s income and the amount of time the child spends with each parent. Mediation provides a forum for parents to discuss and agree upon child support arrangements that are fair and in the child’s best interests.

At AMS Mediation, we understand that each family’s situation is unique. Our experienced mediators are committed to facilitating constructive dialogue, helping parents reach agreements that prioritize the child’s well-being and lay the foundation for effective co-parenting.
